The contract between you and Tanisha Overseas Placements (TOP) when you use this website or our recruitment services.
1. Acceptance of Terms
By accessing or using tanishaoverseas.net ("the Website") or by submitting your résumé, demand notice, enquiry or any other information to Tanisha Overseas Placements ("we", "us", "our"), you confirm that you have read, understood and agree to be bound by these Terms of Use, together with our Privacy Policy, Cookie Policy and Disclaimer. If you do not agree, please do not use the Website or our services.
2. About us
Tanisha Overseas Placements (TOP) is a government authorised international recruiting agency registered in India and operating from 414, Essel House, 10 Asaf Ali Road, New Delhi - 110002. Our recruitment activities for foreign employment are regulated by the Emigration Act, 1983, the Emigration Rules made thereunder, and orders of the Protector General of Emigrants, Ministry of External Affairs, Government of India.
3. Eligibility
You may use the Website only if you are at least 18 years old, have the legal capacity to enter into binding contracts under the Indian Contract Act, 1872, and meet the eligibility criteria for the role(s) you apply to (including, where relevant, the destination country's immigration and labour rules).
4. No fees from candidates
Consistent with Indian law on foreign-employment recruitment:
- We do not charge candidates any fee for registration, profile submission, shortlisting or selection beyond the service charge expressly permitted by the Emigration Act and Rules.
- We will never ask you to pay money into a personal bank account, through unverified payment links, or via cryptocurrency.
- Statutory recruitment service charge, where applicable, is payable only against an official receipt and only after a job has been offered and accepted.
If anyone claiming to represent us asks for unauthorised payments, please report it immediately to our Grievance Officer at grievance@tanishaoverseas.net and to the Ministry of External Affairs' eMigrate portal.
5. Accuracy of information you provide
You undertake that all information you submit (résumé, qualifications, work experience, passport details, contact information, employer demand details, etc.) is true, accurate, complete and current. You are responsible for keeping it up to date. Misrepresentation may lead to suspension or termination of services, ineligibility for current or future placements, and reporting to relevant authorities.
6. No guarantee of placement, visa or employment
While we make reasonable efforts to match candidates with overseas employers, we do not guarantee any specific outcome, including but not limited to shortlisting, interview, job offer, salary level, visa issuance, deployment timeline, or duration of employment. Final selection rests with the foreign employer; visa decisions rest with the destination country's authorities.
7. Acceptable use of the Website
When using the Website you must not:
- Use the Website for any unlawful, fraudulent, harmful or misleading purpose.
- Submit anyone else's personal data without their lawful consent.
- Upload material that contains malware, scripts, or content that infringes third-party rights or violates the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
- Attempt to gain unauthorised access to the Website, the admin area, or any account or system connected to it.
- Interfere with the Website's normal operation (denial of service, scraping at unreasonable rates, etc.).
8. Intellectual property
The Website, including its text, layout, design, graphics, logos, and source code, is owned by Tanisha Overseas Placements (TOP) or its licensors and is protected by Indian and international intellectual property laws. You may view and use the Website for your personal, non-commercial purposes. You must not reproduce, copy, distribute, modify, scrape, or create derivative works from any part of the Website without our prior written consent.

Job listings, requirements, salaries and other details are provided by employers and are subject to change without notice.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, opportunity, goodwill, or data, arising out of or in connection with your use of the Website or services.
- Our aggregate liability for any claim arising out of or related to these Terms or your use of the Website shall not exceed the statutory recruitment service charge actually paid by you (if any) to us in the twelve months preceding the event giving rise to the claim, or INR 5,000, whichever is lower.
Nothing in these Terms limits our liability for fraud, wilful misconduct, or any liability that cannot be excluded under Indian law.
12. Indemnity
You agree to indemnify and hold Tanisha Overseas Placements (TOP), its directors, employees and authorised representatives harmless from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.
13. Suspension and termination
We may suspend or terminate your access to the Website or to our services at any time, without notice, if we reasonably believe you have breached these Terms or applicable law. We may also withdraw or modify any part of the Website at any time.

16. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of India. Subject to the right to seek statutory remedies before consumer or regulatory authorities, the courts at New Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Effective date" and, where appropriate, notified by a banner on the Website. Your continued use of the Website after such updates constitutes acceptance of the revised Terms.
